These Terms govern your access to and use of Bitta.ai (“Bitta,” “we,” “us”) and the AI Employee services we provide through phone, SMS, email, and other communication channels (“Services”). By using Bitta, you agree to these Terms.

1. Overview of the Service

Bitta provides “AI Employees” that communicate by phone, SMS, and email to help with scheduling, quoting, lead intake, and business workflows.

You acknowledge that AI-generated messages may contain errors and should be monitored for critical decisions.

2. Eligibility

• Must be at least 18 years old
• Must represent a valid business or operate as a business owner

3. Account Setup & Verification

You must:

• Provide accurate business and contact information
• Complete phone verification
• Approve opt-in for SMS, email, and phone call notifications
• Keep your login secure

You are responsible for all account activity.

4. Fees and Billing

• Setup fees per AI employee
• Monthly subscriptions
• Usage-based communication charges
• Payments processed via Stripe
• Fees are non-refundable unless required by law

5. Customer Responsibilities

• Ensure your contacts have provided legal consent
• Review important AI outputs
• Comply with all relevant communication laws
• Provide accurate and lawful instructions

You are responsible for all actions taken by your AI Employee.

6. Prohibited Conduct

You may NOT use Bitta to:

• Send unsolicited or non-consensual communications
• Conduct harassment or impersonation
• Upload malware or harmful content
• Violate any communication, privacy, or consumer protection laws

7. Intellectual Property

• You retain ownership of your business data
• Bitta retains ownership of all platform components, AI models, workflows, and communication infrastructure

8. Limitation of Liability

Bitta is provided “as-is.”

Maximum liability = fees paid in last 3 months.

9. Termination

• You may cancel anytime
• We may suspend/terminate for misuse or legal violations

10. Governing Law

Delaware law governs these Terms.
